Child Custody Cases in Dallas, TX: Frequently Asked Questions
As a parent going through a divorce, you probably have a lot of questions about how child custody works in Texas. Balekian Hayes, PLLC, is here to answer your questions and be your trusted guide through negotiating or litigating a fair child custody order. For answers to some of our most frequently asked questions, read on.
Do I Have To Split Child Custody 50/50 With My Ex?
Not necessarily. Child custody is not that cut and dry in Texas. By law, the primary goal is to create a custody plan that is in the child’s physical, emotional, psychological, and educational best interests. This could mean your children will live with one parent and spend regular visitation time with the other parent, or split time between their parents’ homes relatively equally.
Does My Child Have A Say?
If you and your co-parent cannot settle on a child custody order, the judge may ask your children for their opinion, if the kids are old enough and able to express themselves.
If I Get Sole Custody, Will I Also Receive Child Support?
Generally, yes, though ultimately, it depends on the child’s best interests.
My Child’s Mother Took The Kids And Will Not Let Me See Them. What Should I Do?
Contact your family law attorney about enforcing the terms of your child custody order. If there is no custody agreement, that will complicate matters, but we will still work to assert your parental rights.
My Co-Parent Is Behind On Child Support. Can I Deny Their Visitation Time With The Children?
No. There is no connection between a noncustodial parent’s child support obligation and their visitation rights. If you are owed child support, talk to your lawyer about what to do.
